چکیده :

This study aims to examine the legal and criminal dimensions of cybercrime within the framework of the digital economy. The main focus is on analyzing the foundations and scope of criminal liability of offenders, including both natural and legal persons, and proposing solutions to enhance the responsiveness of Iran’s legal system. The research is based on a descriptive–analytical method and document analysis. Data were collected from library sources, academic articles, and international instruments such as the Budapest Convention, and subsequently analyzed. A comparative study of the laws of Iran, the United States, and the European Union was also conducted to identify the strengths and weaknesses of domestic legislation.The findings revealed that cybercrimes in the digital economy are characterized by global reach, technical complexity, and significant economic impacts. Traditional laws have proven inadequate in addressing such crimes, particularly regarding the criminal liability of technology companies, cryptocurrency-related offenses, and the misuse of emerging technologies. While criminal liability of legal entities has been recognized in advanced legal systems, in Iran this issue remains limited.The study emphasizes the necessity of revising domestic laws, explicitly recognizing the criminal liability of corporations, strengthening international cooperation, and improving citizens’ digital literacy. Only through such measures can the threats posed by cybercrime be controlled and the opportunities of the digital economy harnessed for sustainable development.
